Do we need a lawyer?
Hello fellow PBHers. Here is my question. Does my girlfriend need a lawyer to receive full custody of her son. The father of the child lives in the United States. He is married to an American woman. He is listed as the father on the birth certificate, but that is all he has ever done as a father. He abandoned the child when he was born. The child is now 6. The child has always been in the care of my girlfriend and her family. I desire to be married with my finance. I want them to apply for a visas. The father of the child who now lives in America will not give his consent. But he himself lives in the United States. Nor does he support the child in anyway. Me and my finance desire to be married. I believe she must go to ICBF for custody. Is this the best and only route? How long shall this take? Do the courts search for him in the United States? Do we need a lawyer? Is there anything I am missing? If anyone can give me insight or any other help, it would be greatly appreciated.

That might have to be a route in which we consider going, but as this juncture we are trying to complete this without his help or involvment. There must be something we can do, the fact is he has not been a father in anyway for the child. If I can get the Colombian courts to legally remove his status as a legal guardian of the child, it would remove any threat from him now or in the future. It would also remove his control of the child's life. And if I threaten him, it is possible he states that he had signed the release for his child under duress.
